Terms and Conditions of Sale

1. General Provisions.

These general terms and conditions of sale (hereinafter, "General Terms and Conditions") apply to all sales of products (hereinafter, "Products" or the "Product") purchased through the website gsaudio.it (hereinafter, "Site").

The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or the "Customer"), understood as natural persons acting for purposes unrelated to their commercial, entrepreneurial or professional activity, if any.

The Customer is obliged to read carefully the General Conditions that have been made available to him/her on the Site, in order to allow their storage and reproduction by the Customer pursuant to Article 12 of Legislative Decree No. 70 of April 9, 2003.

Contracts entered into with Gs Audio SRL - Via Matteotti 220/A San Possidonio MO, 41039 - P.Iva 04075510364 (hereinafter, "Gsaudio") through the Site are governed by Italian law and, in particular, by Legislative Decree September 6, 2005, n. 206 ("Consumer Code") and Legislative Decree April 9, 2003, n. 70 (hereinafter, "Ecommerce Decree").

3. Information Relating to the Products

Information relating to the Products susceptible to distance sales through the Site, including the relevant product codes, is available on the Site. The aforementioned information is provided in accordance with Articles 52 and 53 of the Consumer Code.

4. Price

Product prices are inclusive of all taxes and duties for Italy and for European private customers, while they are tax-free, i.e. net of VAT, duties and taxes, for customers outside Europe. All prices are in Euros or other currencies selectable on the website, with currency exchange updated daily.

Shipping costs are the responsibility of the customer, except for possible promotions.

5. Ordering the Products

The essential characteristics and prices of the Products are given in the offer for each Product.

To purchase a Product, the Customer must complete the order on the website, selecting the payment method and proceeding to payment.

In order to place an order, the Customer must add the Product in the appropriate "shopping cart" and, after having read the General Conditions - with particular reference to the delivery costs, the procedures for exercising the right of withdrawal and the Privacy Policy - must select the desired payment method and confirm the purchase.

Before placing the order, the Customer will have the opportunity to correct any data entry errors by following the editing procedure provided on the Site. In particular, the Customer will be able to change the quantity of the Products he/she intends to purchase by adding or removing one or more Products from the "shopping cart".

By sending the order, the Customer acknowledges and declares that he/she has read all the information provided during the purchase procedure and fully accepts the General Conditions.

The Customer will be able to view their orders through the "My Profile" area of their account.

Gs Audio reserves the right to evaluate the acceptance of orders received. Any inability to accept an order will be communicated to the Customer within 14 days from the date of transmission of the order. In this case, Gs Audio will refund the amounts already paid by the Customer.

6. Method Of Payment

The Customer may make payment for the Products and related delivery charges by credit, debit or prepaid cards with international circuit, bank transfer or payment in installments through the Almapay circuit. Cash on delivery, money orders, Postepay recharges are not accepted and, at the moment, payment via PayPal is not available.

Orders are processed only after actual receipt of payment. If, for any reason, the charge of the amount due is not successful, the order will be automatically canceled and the sale cancelled.

7. Confirmation Receipt Of Order.

In accordance with Art. 53 of the Consumer Code, upon conclusion of the contract, the Customer will receive by e-mail a confirmation of receipt of the purchase order, containing a detailed summary of all elements of the order.

8. Ineffectiveness Of The Order

No contract shall be deemed concluded between Gs Audio and the Customer if there are reasonable grounds to believe that the order is not placed with a real and genuine interest in the purchase of the products, or in the event that the Customer abuses the right of withdrawal provided for in Article 12 of the Consumer Code, which regulates the right of withdrawal in distance contracts and off-premises, establishing the procedures and terms for its exercise.

In such circumstances, the submitted order will be ineffective. Gs Audio will notify the Customer, by e-mail, of the non-conclusion of the contract and will provide for the cancellation of any charges and/or expenses charged to him.

9. Transport And Delivery

The Products purchased on the Site will be delivered to the shipping address indicated by the Customer. The latter has the right to request delivery to another natural person, specifying their details in the shipping address. At the time of delivery, the signature of an adult of legal age (+18 years) will be required. We do not deliver to P.O. boxes.

For each order placed on the Site, Gs Audio will issue an invoice or tax receipt for the goods shipped, sending it to the holder together with the order, in accordance with Presidential Decree 445/2000 and Legislative Decree 52/2004. The invoice will be issued based on the information provided by the Customer at the time of the order. After issuance, no changes will be possible.

Delivery costs are the responsibility of the Customer and are clearly indicated on the Site and in the order form.

All purchases are shipped by courier from Monday to Friday, excluding holidays and national holidays. In Italy, delivery is expected within 1-2 working days after the courier picks up the package in the case of express shipping, while with standard shipping the time varies between 2 and 5 working days. For shipments within Europe, truck shipping is expected to take between 2 and 5 business days for parcels, while for pallets the time can vary indicatively between 4 and 10 business days, depending on the country of destination.

GS Audio is not responsible for any unpredictable delays. During periods of high demand, such as December and August, deliveries may be delayed by 1-2 days, independent of GS Audio and due to the courier or carrier.

If the order includes pre-assembled kits, handmade materials, such as complete recontouring, 3D gadgets, composite fiber materials, spider stitching, Made-in-Italy and/or custom subwoofers, Gs Audio reserves the right to ship when materials are actually available, post production. In such cases, the standard order preparation time of 24 hours may not be met and, depending on the size of the order, it may take from 1 to 10 business days.

However, in accordance with the Consumer Code, Products will be delivered within a maximum of 30 days from the day after the order is placed, unless otherwise notified by Gs Audio. If, within this period, Gs Audio communicates by e-mail the inability to deliver the goods due to a supervening unavailability, even temporary, the Customer will be entitled to a refund of any sums already paid for the order.

If, following a communication from Gs Audio regarding a delay in the delivery date, the Customer wishes to cancel the order, any amount already paid will be refunded as soon as possible and in any case within 30 days from the day after the order was sent. The refund will be made using the same payment method chosen by the Customer at the time of purchase.

Once the shipment has been processed by the operating office and is in transit, the responsibility for delivery passes to the courier. Therefore, Gs Audio is not responsible for delays or any issues related to orders in transit status and will not accept refund or cancellation requests for such orders. Any claims for damages, delays, or other issues will be handled by Gs Audio only after receipt of the goods by the Customer or upon return at our warehouse.

Delivery of the goods requires the presence of the Customer or its designee at the address indicated in the order. Upon delivery by the courier, the Customer is required to verify that the number of packages corresponds to the number indicated in the transport document and that the package is intact and not altered. Any damage to the package and/or products or discrepancies in the number of packages must be immediately contested by means of written control reservation on the courier's proof of delivery.

Once the courier's document has been signed or the package accepted, no further disputes can be made regarding the external condition of the delivered goods.

10. Right of withdrawal

Pursuant to Article 64 et seq. of the Consumer Code (Legislative Decree 206/2005), the Customer has the right to withdraw from the purchase contract, without having to provide reasons and without penalty, for all products available on the shelf or in stock at Gs Audio. This right does not apply to customized products requested and manufactured at the Customer's specific request, regardless of the channel of purchase, be it the website, telephone, e-mail, or direct request at Gs Audio's headquarters.

To exercise the right of withdrawal, the Customer must return the goods, at its own expense, within 10 days of receipt to the address:

You must include a reminder inside the package with a request for a refund or replacement of the item. For customized products that have already been made, shipped and subsequently returned, the only form of refund provided is a voucher of equal value, minus the shipping costs for sending and returning. Return shipping costs are always the responsibility of the Customer.

In the event of receipt of an incorrect or damaged item, the Customer must contact Gs Audio, who will replace the product, arranging for the erroneous/damaged item to be picked up by its courier.

Refund of the order will be made in the following ways:

Credit/debit card (if used for purchase): refund processing takes 2-5 business days from receipt of returned merchandise.
Bank transfer (if payment was made by wire transfer): refund will be credited within 2-5 business days of receipt of the goods.

Conditions of the Right of Withdrawal

The right of withdrawal is subject to the following conditions:

It can only be exercised for the product in its entirety; individual parts of a purchased item cannot be returned.
Shipping costs for the return are the responsibility of the Customer, as required by current regulations.
The return shipment is the total responsibility of the Customer until confirmation of receipt by Gs Audio.
Gs Audio is not liable for damage, theft or loss of goods returned by uninsured shipments.
If the product is damaged in transit, Gs Audio will inform the Customer within 5 working days of receipt of the return so that he/she can file a claim with the carrier for a refund (if the item was insured). In this case, the product will be made available to the Customer and the withdrawal request will be cancelled.

Gs Audio will refund the full amount paid by the Customer within 14 days of receipt of the goods, by credit card charge reversal or bank transfer. For the transfer, the Customer must provide their bank details (ABI, CAB and account number in the name of the person named on the invoice).

The right of withdrawal lapses completely in the following cases:

Lack of the original packaging and/or protective wrapping of the product (e.g. coil, spider, glue, etc.).
Damage to the product due to causes other than transportation.

In such situations, Gs Audio will return the goods to the Customer, charging the shipping costs.

Conformity defects

In the event of conformity defects in products sold by Gs Audio through the gsaudio.co.uk website, the Customer should promptly contact support at the following e-mail address info@gsaudio.it.

The purchase of the products is covered by the legal guarantees provided for in Articles 129, 130 and 132 of the Consumer Code. The Customer has the right to free restoration of conformity of the goods through repair or replacement, or, in cases provided by law, to a reduction in price or termination of the contract. The Customer forfeits these rights if he does not report the lack of conformity to Gs Audio within 14 days from the date of receipt of the goods or service. Action to enforce any defects not maliciously concealed by Gs Audio shall in any event be time-barred within two months after delivery of the goods.

12. Errors

The product information on the Site is constantly updated, however, no guarantee can be given that it is absolutely error-free. Gs Audio reserves the right to correct any inaccuracies, errors or omissions, even after an order has been placed, as well as to change or update the information at any time without notice.

13. Applicable Law and Jurisdiction

These General Conditions are governed by Italian law and must be interpreted in accordance with the regulations in force in Italy. For disputes relating to theinterpretation, validity or execution of these General Conditions, the mandatory territorial jurisdiction is attributed to the judge of the place of residence or domicile of the consumer, if located in Italy.
